The organizers for Miss Universe Canada will not allow a transgender contestant to participate in the May pageant, saying that although she may feel like a woman, rules say she must be born a female, the Toronto Star reported. ?

Denis Davila, the national director of the Miss Universe Canada franchise, told the Vancouver Sun that the contestant, Jenna Talackova, a native of Vancouver, British Columbia, wrote on her registration that she was born female. He suspected that she was born male and asked her about it earlier this month. She was dismissed that day.

Davila said that the Miss Universe franchise requires that contestants be ?naturally born female,? according to the Sun.


?She feels like a real girl and she is a real girl. She didn?t expect people to question it,? Davila told the Sun. ?She was hoping we could put her back in the competition, but the rules are very clear and there?s no way we can go back on it.?

He added: ?She was excited about the competition. Just because she can?t compete doesn?t mean we stopped loving her.?

Those rules are not mentioned on the Miss Universe website, which states that contestants must be unmarried and 18 years or older.?

Mara Keisling, who heads the National Center for Transgender Equality based in Washington, D.C., told the Toronto Star that she questioned the decision.

"From what I've read, it doesn't sound like they had any rules," Keisling said. "It seems like they made them up on the fly to disqualify her. It makes you wonder what they're afraid of."

A change.org petition initiated for Talackova quoted her Twitter feed, which has since been hidden.

Talackova wrote, according to the petition, that she was ?disqualified for being born.?

On March 18, before learning she had been disqualified, she tweeted: ?Still waiting to know if I?m able to compete ... praying and fingers crossed.?

When she was disqualified two days later, Talackova wrote, ?I?m not giving up. I?m not going to just let them disqualify me over discrimination.?

In 2010, when she was 19, Talackova competed in Miss International Queen, a competition for transgender and transsexual people. In an interview posted on YouTube, she said she knew she was a girl at age 4.

Speaking with a girlish lilt, the tall blonde contestant said that she started hormone therapy at age 14 and underwent a sex change surgery at 19.

A brief statement released Friday on the front page of the website for Beauties of Canada, the company that oversees the Miss Universe Canada pageant, stated that Talackova was removed from the competition ?because she did not meet the requirements to compete despite having stated otherwise on her entry form.?

Canada is one of the four countries along with France, Germany and the United States that have competed in every Miss Universe pageant since it was created in 1952. The Miss Universe Canada pageant will be held on May 19 in Toronto.

Many legal experts initially dismissed as ridiculous the core constitutional challenge being lodged against the health-care reform law, yet the case is now poised to produce a potential landmark decision ? regardless of whether the law is upheld or struck down.

Three federal judges have struck down the so-called individual mandate as unconstitutional, while three others have upheld it. At the appellate level, the Atlanta-based 11th US Circuit Court of Appeals struck it down, while the Sixth US Circuit in Cincinnati and the District of Columbia Circuit in Washington both upheld it. The Richmond, Va.-based Fourth Circuit dismissed the lawsuit without reaching the individual mandate issue.

Among the challenging plaintiffs at the high court will be the State of Florida, joined by 25 other states, the National Federation of Independent Business, and several individuals. More than 150 legal briefs have been filed by several hundred lawyers, among them an elite group of advocates set to argue the case.

Public opinion is tilted against the individual mandate, with 51 percent saying it should be declared unconstitutional, and 28 percent saying it should be upheld, a Kaiser Family Foundation poll found.

Hello Liza, My husband and I need to update our wills, they are terribly out of date.??Our?dilemma?is around the question of who should be Executor/Co-Executor of the estate. Obviously we would be the executors of one an others estates, however, if something were to happen to both of us, we need a third party Executor/Co-Executor. ?We have no obvious relatives, or even close friends that we feel could ask to be an Executor.???We?ve understand that a law firm, bank, financial planner, etc.can act as an Executor (or co-Executor). ?Our question is, what is the financial obligation for doing so???Trust companies, trust departments of banks, and individuals, called professional fiduciaries, can serve as the executor of your estate.? There?s no up front fee for nominating an institution or professional to serve in that capacity. They would charge the estate a fee for their services if they are appointed to serve after the death of the second of you.? Often, these fees are a percentage of the estate. If your estate goes through probate, your executor is awarded statutory fees based on state law, which are usually a percentage of the value of the estate.? Attorneys sometimes serve in this capacity, but, at least in the state where I practice (California) there are strict rules about doing so, because in the past unscrupulous lawyers wrote themselves into client?s documents to generate future fees. Financial advisors often cannot serve due to conflict of interest rules in their companies, but some can.? I would advise you to ask your local bank or financial advisor what their fees would be for this service, or if they can recommend anyone in your area who could serve.

When advising people on buying most performance-oriented components, we usually recommend taking a single step back from the top of the line: There?s frequently a bigger difference in price than in capability between the bleeding edge and the next best. That?s unquestionably the case with the Intel Core i7-3930K, the second most powerful CPU in Intel?s Sandy Bridge?Extreme line. No, it doesn?t have all the bells and whistles and shoot-the-moon speed characteristics of the line?s flagship model, the Core i7-3960X Extreme Edition. But coming in at almost half the price ($583 list versus $999 list), it will prove for all but the most hard-core die-hards to be The Chip You Want if you?re committed to Intel?s knock-'em-dead X79 Express platform.

Even on paper, the differences between the two CPUs look ridiculously slight. The Core i7-3930K has 12MB of cache to the faster chip?s 15MB, and a clock rate of 3.2GHz instead of 3.3GHz that can rise to a maximum of 3.8GHz instead of 3.9GHz when Turbo Boost is enabled. But that?s about it. Both chips use Intel?s 32nm production process, both have six CPU cores that can manage up to 12 processing threads at a time thanks to Hyper-Threading, and both have TDPs of 130 watts. This chip, like the Core i7-3960X, requires an X79 Express motherboard with an LGA2011 socket; a discrete video card, as the chip sports no integrated graphics system (despite its use of the Sandy Bridge microarchitecture, which provided one on the Core i7-2600K and Core i5-2500K); and a separate cooler, as Intel does not bundle one with any CPU in this line.

Most enthusiasts will consider these small prices to pay?and paying them will be a pleasure given how much you save over the Core i7-3960X for what amounts to nearly equivalent performance. We saw with the non-Extreme Sandy Bridge Core i5-2500K last generation that you can still draw remarkable performance from a next-in-line chip, and our benchmark tests show that Intel has continued that welcome tradition here.

As evaluated on a test system using an Asus P9X79 Deluxe motherboard, the Core i7-3930K applied a dozen filters and effects to an image in Adobe Photoshop CS5 in 2 minutes 53 seconds, as opposed to the Core i7-3960X?s 2 minutes 48 seconds. Video conversion using the open-source program Handbrake took 1 minute 8 seconds, whereas on the Core i7-3960X it was only two seconds faster. In the CineBench R11.5 rendering task, the slower chip?s scores (10.17 for multiple cores, 1.53 for a single core) were just a hair behind those of the faster one (10.48 and 1.57, respectively). The Core i7-3930K?s results on the Futuremark 3DMark 11 physics test (10,958 and a frame rate of 34.78 frames per second, or fps) were barely behind those of the Core i7-3960X (11,509 and 36.54fps). On the full-system Futuremark PCMark 7 benchmark, the scores followed exactly the same pattern: The overall score was 3,643 versus 3,594, with the individual tests similarly matched.

Our tests calibrated for more component-level performance, AIDA64, SiSoftware Sandra 2012, and Geekbench 2.2, proved just as conclusive: There is almost no performance differential between the Core i7-3930K and the Core i7-3960X that most users will find significant enough to be worth the extra $416 or so it will cost to get them. You should note, however, that you also won?t save a significant amount on energy usage: In our measurements conducted with an Extech Datalogger, the Core i7-3930K?s 122.5-watt draw at idle and 233.7-watt draw under full load was not far removed from Core i7-3960X?s respective 124.1-watt and 243.2-watt draws. But if you?re building a system using either of these CPUs (and the likely video cards and other hardware they?ll require), your energy bill is probably not the first thing on your mind.

We?re hard pressed to come up with too many negatives about the Intel Core i7-3930K: It?s a gorgeously balanced CPU that will net you a super-fast computer without sending you on a super-fast trip to the poorhouse, too, and that makes it easily worth an Editors? Choice award in our book. Those who simply cannot settle for anything less than the maximum allowable CPU speed will, of course, prefer the Core i7-3960X, and find those few additional drops of performance worth the money. But everyone else is probably better off with the Core i7-3930K: Whether or not you see fit to overclock it (and if you do, the unlocked multiplier guarantees that you won?t have any trouble pushing it past the Core i7-3960X?s base speed), it?s an amazing processor at an amazing price.

Romney takes lead in Illinois, hoping to pull away

SCHAUMBURG, Ill. (AP) ? Backed by a crushing television ad advantage, Mitt Romney jumped ahead of Rick Santorum in early returns from the Illinois primary Tuesday night, bidding for yet another industrial-state triumph in the race for the Republican presidential nomination.

Romney held a second advantage as well, this one in the competition for Illinois delegates to the party convention next summer. Santorum was ineligible for 10 of the 54 at stake after failing to field a full slate.

Returns from the first few Illinois precincts showed Romney with 55 percent of the vote, compared to 29 percent for Santorum, 9 percent for Ron Paul and 7 percent for Newt Gingrich.

Preliminary exit poll results showed Romney preferred by primary goers who said the economy was the top issue in the campaign, and overwhelmingly favored by those who said an ability to defeat President Barack Obama was the quality they most wanted in a nominee.

The primary capped a week in which the two campaigns seemed to be moving in opposition directions ? Romney increasingly focused on the general election battle against Obama while Santorum struggled to escape self-created controversies.

Most recently, Santorum backpedaled after saying on Monday that the economy wasn't the main issue of the campaign. "Occasionally you say some things where you wish you had a do-over," he said later.

While pre-primary polls taken several days ago suggested a close race, Romney and Restore Our future, a super Pac that backs him, unleashed a barrage of campaign ads to erode Santorum's standing. One ad accused the former Pennsylvania senator of changing his principles while serving in Congress, while two others criticized him for voting to raise the debt limit, raise his own pay as a lawmaker and side with former Sen. Hillary Rodham Clinton to support legislation allowing felons the right to vote.

In all, Romney and Restore Our Future outspent Santorum and a super PAC that backs him by $3.5 million to $500,000, an advantage of 7-1.

Neither Newt Gingrich nor Ron Paul campaigned extensively in Illinois.

Romney and Santorum did, though, and not always in respectful tones.

"Senator Santorum has the same economic lightweight background the president has," Romney said at one point. "We're not going to replace an economic lightweight with another economic lightweight."

Santorum had a tart reply. "If Mitt Romney's an economic heavyweight, we're in trouble."

Including Romney's victory last weekend in Puerto Rico, the former Massachusetts governor had 522 delegates going into the Illinois voting, according to The Associated Press count. Santorum had 253, Gingrich 135 and Paul 50. If Romney continues on the same pace, he will lock up the nomination before the convention opens in Tampa, Fla., next August.

However, the Santorum campaign argued Tuesday that the race for delegates is closer than that.

Santorum contends the Republican National Committee at the convention will force Florida and Arizona to allocate their delegates on a proportional basis instead of winner-take-all as the state GOP decided. Romney won both states.

On Tuesday, about four in 10 voters interviewed as they left their polling places said they were evangelical or born again. That's about half the percentage in last week's primary states of Alabama and Mississippi, where Santorum won narrowly. Despite an unusually lengthy race for the nomination, less than a third of those voting said in the polling-place survey they hoped the primary season would come to a quick end even if that meant their candidate might lose the nomination.

The findings came from preliminary results from the survey of 1,078 Illinois Republican voters, and had a margin of error of plus or minus 4 percentage points. The exit poll was conducted for The Associated Press and the television networks by Edison Research at 35 randomly selected polling places around the state.

As Illinois Republicans voted on Tuesday, Romney raised more than $1.3 million at a luncheon in Chicago. He planned an election-night event in nearby Schaumburg, Ill., while Santorum was in Gettysburg, Pa., site of Illinois favorite son Abraham Lincoln's most famous speech.

Santorum, the former Pennsylvania senator, has been seeking to make up in broadcast interviews what he has lacked in advertising money.

On Monday, his campaign began before sun-up and ended well after dark, including four appearances at rallies around the state as well as an extraordinary 19 radio and television interviews. He accused Romney anew of putting his signature on a Massachusetts health insurance law that is similar to the one Obama pushed through Congress.

Romney cut short his planned time in Puerto Rico, site of a primary last weekend, to maximize his time in Illinois. He has eked out victories in other big industrial states over the past few weeks, beginning in Michigan on Feb. 28 and Ohio on March 6. Defeat in any would be likely to trigger fresh anxiety within the party about his ability to wrap up the nomination.

Illinois was the 28th state to hold a primary or caucus in the selection of delegates to the nominating convention, about halfway through the calendar of a Republican campaign that has remained competitive longer than most.

A change in party rules to reduce the number of winner-take-all primaries has accounted for the duration of the race. But so has Romney's difficulty in securing the support of the most conservative of the GOP political base. Santorum and Gingrich have struggled to emerge as the front-runner's sole challenger from the right.

Whatever the reasons, the race appeared unlikely to end soon, with Santorum and even Gingrich vowing to campaign into the convention.

Next up is a primary Saturday in Louisiana where Santorum projects confidence following twin triumphs a week ago in Alabama and Mississippi. There are 25 delegates at stake.

Behind Louisiana is a three-primary night in the District of Columbia, Maryland and Wisconsin on April 3, with 95 delegates combined at stake.

Santorum is not on the ballot in Washington, D.C., but is ahead in opinion polls in Maryland. Wisconsin ? adjacent to Illinois ? shapes up as the most competitive primary of the night.

Mauritania to hand over ex-spy chief to Libya

(AP) ? Mauritania will hand over one of Moammar Gadhafi's closest associates, former Libyan intelligence chief Abdullah al-Senoussi, for trial in his home country, a Libyan official said Wednesday.

"The Mauritanian government has given their agreement for the extradition of Abdullah al-Senoussi to Libya so he can be judged by a fair process," said Libyan spokesman Nasser al-Manei.

He did not say when the move might happen, but said the Libyan delegation had visited al-Senoussi in his cell in Mauritania's capital and confirmed his identity.

The former intelligence chief is accused of attacking civilians during the uprising in Libya last year and of the 1989 bombing of a French airliner. He was considered Gadhafi's "black box" and known to be among his inner circle of confidants. He was also the ousted leader's brother-in-law.

Al-Senoussi was detained Saturday in Mauritania.

The International Criminal Court, France and Libya have all said they want to prosecute al-Senoussi.

He is wanted in Libya for a number of crimes, including his alleged role in the Abu Salim prison massacre of more than 1,200 prisoners by Gadhafi's regime in 1996.

Judges at the Netherlands-based ICC issued an arrest warrant for al-Senoussi last June on two counts of crimes against humanity ? murder and persecution ? for allegedly masterminding attacks on civilians in the early days of the uprising that eventually toppled Gadhafi from power.

Mauritania is not a member of the court.

The court also indicted Gadhafi but the ousted leader was killed by rebel fighters in October. Libyan authorities say they want to put Seif al-Islam, one of Gadhafi's sons, on trial at home instead of turning him over him to the court.

Libyan officials are currently holding Seif al-Islam, who was arrested in November by fighters in Libya's remote southern desert. The former heir apparent has been held largely without access to the outside world ever since.

France convicted al-Senoussi and five other Libyans in absentia and sentenced them to life in prison in France for the 1989 bombing of a passenger jet over Niger that killed all 170 people on board including 54 French people. The French government asked last year that he be handed over to France when captured.

CINCINNATI (AP) ? A man who made comments about his estranged wife on his Facebook page and was threatened with jail unless he posted daily apologies for a month won't be locked up even though he stopped making amends early.

Mark Byron agreed to begin posting the apology last month to avoid jail but later said the ruling violated his freedom of speech. He stopped posting the apology after 26 days, but Judge Jon Sieve, of Hamilton County Domestic Relations Court, determined Monday that he had posted it long enough, and Byron wasn't jailed.

Byron, of Cincinnati, said afterward that he was relieved not to be in jail, "but I was prepared to go to defend my free speech rights."

Byron's attorney, Becky Ford, said Monday that she has filed a notice of appeal in a state court.

"We believe that by scripting and saying what he had to post on Facebook, the court violated his rights to free speech," Ford said. "The First Amendment not only protects your right to speak, but it also protects your ability to remain silent."

According to the ruling, Byron, 37, had posted comments on his page in November, saying in part, "If you are an evil, vindictive woman who wants to ruin your husband's life and take your son's father away from him completely ? all you need to do is say you're scared of your husband or domestic partner and they'll take him away."

The Byrons have been involved in ongoing divorce and child custody proceedings. Byron has said his wife and the court have prevented him from seeing his young son many times. The court maintains he is allowed to see him on a twice-weekly basis.

A June court order prohibited Byron from causing his wife physical or mental abuse, harassment or annoyance. She asked in December that he be found in contempt after learning of the Facebook comments.

Domestic Relations Magistrate Paul Meyers in January found Byron in contempt of a protective order because of his Facebook comments. He said Byron could avoid a 60-day jail sentence and a $500 fine by posting the apology ? written by the magistrate ? to his wife and all of his Facebook friends and paying her attorney fees. The same apology had to be posted every day no later than 9 a.m.

The ruling said several of Byron's comments were intended to "generate a negative and venomous response toward her from his Facebook friends."

Byron said Monday that, even if he didn't go to jail, "this is a really big deal" for hundreds of millions of people using Facebook.

"They could do this to anybody," he said.

Free speech and media experts have said that the case should concern other users of the social networking site.

Cincinnati attorney Jack Greiner, who specializes in free speech and media issues, said earlier that compelling speech through a court-written apology raises as many free speech concerns as prohibiting speech. He said Monday that the issue still causes concern but that he believes Byron might have difficulty appealing since he posted the apology and didn't go to jail.

The statement Byron posted had him apologizing to his wife for "casting her in an unfavorable light" and to his Facebook friends for "attempting to mislead them."

He says that in addition to standing up for his rights, he stopped posting the apology "because it forced me to make false statements."

The estranged wife's attorney, Joel Moskowitz, said he was disappointed that Byron did not get any jail time.

We're entering the homestretch of first-round voting in the 2012 MTV Musical March Madness tournament — polls close on Sunday at midnight ET — but there's still time to help guide your favorite band to victory ... or at least to round two.

Because as history has shown us time and time again, there are no guarantees when it comes to MMM, as heavily favored bands fall by the wayside and unheralded underdogs make deep tourney runs. Of course, it's all up to you — you can spread the word by downloading one of our custom MMM badges, or by using the hashtag #MMM on Twitter — but to help with any last-minute decisions, we've spent all week breaking down each of the March Madness regions.

We started with the mighty Midwest and moved on to the wild West and the erudite East. Today, we'll close with the down-and-dirty South, which has produced both the 2010 champion, Coheed and Cambria, and the 2011 runner-up, Paramore. And this year, well, it looks like that tradition could continue.

Because the 2012 South region once again features not only Paramore but Evanescence (who might very well be the team to beat) and MMM powerhouses like 30 Seconds to Mars and Linkin Park too. One of those four bands is going to advance to the Final Four ... and stands a pretty good chance at winning it all. But we're getting ahead of ourselves. Here's a look at all the first-round matchups in a very loaded South.

#1 Evanescence vs. #16 Alabama Shakes: Pity the 'Bama Shakes, who were playing near home but drew the all-powerful Evanescence in round one. Not surprisingly, this one was over early, and given EV's 17,000-vote cushion, we're thinking they'll advance to round two. In fact, they might not be challenged until the Sweet 16, with a potential matchup against Linkin Park looming.

#2 Paramore vs. #15 Gotye: Sure, Gotye spent the weeks leading up to MMM practicing his pick-and-roll, but when the tourney began, he got appropriately rolled by Paramore, who clearly have bigger things on their minds. Much like Evanescence, they won't face a tough opponent until the Sweet 16, where they'll probably meet 30 Seconds to Mars.

#3 Kings of Leon vs. #14 Phoenix: Will this be the year the Kings make a deep run in the tourney? Um, probably not. For the second time in three years, they appear headed for a first-round exit, this time at the hands of Phoenix, who hold a pretty hefty lead. Surprisingly, this would be the third-straight year they make it to round two ... the trick now seems to be figuring out how to advance from there.

#4 Jack White vs. #13 Shinedown: White goes it alone in MMM 2012, and so far, he's finding it tough to shoulder the load. He owns a slim lead over upset-minded Shinedown, who look to continue the recent trend of heavy bands going deep in the tournament. Though they're trailing, we like Shinedown's spirit, and we're picking them to knock off White and advance.

#5 Linkin Park vs. #12 At the Drive-In: Last year, LP made it all the way to the Sweet 16 before getting bounced by Paramore. This year, we're pretty confident they'll make it past ATDI in round one (they're up by some 12,000 votes), but the selection committee certainly didn't do them any favors after that: They'll have to get past Evanescence if they want to finally taste the Elite 8.

#6 30 Seconds to Mars vs. #11 Sleigh Bells: Obviously, the selection committee has it out for the poor Sleigh Bells, who drew Linkin Park in the opening round last year and got 30 STM this year. As you'd probably expect, Jared Leto and company hold a sizable lead here and are locks to move on. Again though, Paramore await in the Sweet 16.

#7 Cage the Elephant vs. #10 Ke$ha: A surprisingly competitive 7/10 battle unfolding here, as Cage crept to the early advantage, then watched as Ke$ha — and her Kegels — roared all the way back to take the lead. This one's still too close to call, though perhaps this is finally the year Ke$ha advances to round two.

#8 My Morning Jacket vs. #9 Dave Matthews Band: This potential Birkenstock-burner has basically been a snoozer (our lowest-voted opening-round matchup), which may have something to do with MMJ and DMB fans being too, uh, sleepy to vote. It's the DMB by a bong rip so far, though given that the winner of this contest gets Evanescence next, well, does it really matter who wins?
